Delhi High Court has agreed to hear the plea challenging the decision of the Delhi University to conduct online open book examinations (OBE) for undergraduate as well as the postgraduate students.
The said plea will be heard by the Division Bench of Justice Hima Kohli and Justice Subramonium Prasad which is already entrusted with a series of petitions challenging the Delhi University's decision to conduct OBE.
Moved by National Federation of the Blind, the petition seeks to challenge the notifications dated 30th May, 2020 and 1st June, 2020 of the Delhi
University (DU), for holding open book examinations remotely for the final year, term semester students of the various undergraduate and postgraduate programmes.
The Petitioner has argued that the said decision of the Delhi University is against the rights of students with visual impairment and other disabilities under the Rights of Persons with Disability Act, 2016.
This petition was originally moved before the Division Bench of Justice Rajiv Sahai Endlaw and Justice Asha Menon. However, the said Bench by an order dated July 13, has decided to transfer the said petition to the Division Bench headed by Justice Hima Kohli for the following reason:
'It is apposite that all the petitions concerning the examination are heard and decided by one Bench only, to avoid conflicting orders and any further chaos.'
Today, the Division Bench of Justice Hima Kohli and Justice Subramonium Prasad, while hearing the batch petitions challenging the DU's examination notification, has directed the concerned ministry of the Central Government to ensure that Common Service Centres are made functional and that they are made well equipped to meet the demands of PwD category students.
The Centre is directed to submit an affidavit addressing these concerns before July 24
