The Delhi High Court on Monday stayed the trial court proceedings against BJP MP Gautam Gambhir, his Foundation, and other persons in the case concerning alleged hoarding and illegal distribution of Covid-19 drugs during the second wave.

Justice Rajnish Bhatnagar issued notice on the petition filed by Gautam Gambhir Foundation, Seema Gambhir, Gautam Gambhir, Natasha Gambhir. The plea challenges the summoning order passed by the trial court and also the criminal complaint against the foundation.

While listing the matter for further hearing on December 8, the Court also sought response of the Drugs Control Department of the Delhi Government. 

The Drug Controller of Delhi Government had launched a prosecution in the Court of law against Gautam Gambhir Foundation, it's trustees and CEO on July 8 for contravening the provisions of Drugs & Cosmetics Act, 1940.

Additionally, prosecution was launched against two Aam Aadmi Party MLAs namely Praveen Kumar and Imran Hussain over similar allegations.

An inquiry was made by the investigating team in respect of specific allegations against BJP MP Gautam Gambhir and AAP MLAs for hoarding and illegally stocking Covid-19 medicines and drugs while conducting free medical camp.

Last month, a Delhi Court had adjourned hearing in matter till first week of February 2022.

Earlier, the High Court had pulled up the Drug Controller of the Delhi Government for its "unsatisfactory inquiry/Investigation" in the matter.

"You want us to shut our eyes. You can't take is for a ride. If you think we are so gullible, we are naive, we'll give you back hard. You better do your job," the Court had said.

The Court was then informed that the Delhi Government wishes to withdraw the Prosecution launched against such persons or organisations who were involved in free distribution of medical oxygen to Covid patients without any wrongful intention.
