The High Court of Delhi has issued notice in a Writ Petition filed by a student, alleging hostile discrimination done by the Govt. of Delhi against graduates of 3 years LLB course.
The petition was filed by Akash Verma, impugning the notification issued by central government on 28.05.2019, inviting applications from graduates in Law for appointment as Legal Research Associates on contract basis. It was contended that the advertisement called for only 5 years law course graduates, which was arbitrary and discriminatory against the students of 3 years law course.
Taking note of the prima facie discrimination, Justice Vibhu Bakhru stated that both the qualifications were of equivalent value and the government notification was liable to be stayed. The state cannot process any application pursuant to the notice until further orders. The court however, granted liberty to the Respondent State to amend the notification so as to include the 3 years law course students, in which case the stay order would become inoperative.
