Granting protection to an inter faith couple facing threats from woman's family, the Delhi High Court has made the Delhi Police officials including an ACP and SHO of the concerned area liable in case of any lapse in the security and protection of the couple.
Justice Chandra Dhari Singh was dealing with a protection plea filed by the couple seeking directions on the police to protect their life and liberty from the family members of the woman, being respondents no. 3 to 5 in the matter.
While the woman was 26 years of age, the man was 24 years old. The couple had married each other in an Arya Samaj Mandir as per Hindu rites and ceremonies after having a love affair.
Advocate DK Santoshi appearing for the petitioners submitted that that since it was an inter-religious marriage, there were serious threats to life and liberty of the petitioners from woman's family members.
He specifically mentioned an incident dated 11th December 2021, wherein the woman was merciless beaten by her family members.
Additional Standing Counsel RS Kundu appearing for the State sought time to file the status report in the matter and stated that adequate protection shall be provided to the petitioners.
Issuing notice on the petition, the Court ordered thus:
"It is made clear that if any lapse occurs in the security/protection of the petitioners, the ACP of Ashok Vihar area and the SHO, Police Station Keshav Puram shall be held liable."
The matter will now be heard on January 24, 2022.
Appearances: Advocates D.K. Santoshi and Rahul Kumar Singh appeared for the petitioners. ASC R.S. Kundu along with Advocate Shivani Sharma appeared for State.
