The Delhi High Court has recently directed a man, who was accused of forcefully kissing a woman and outraging her modesty, to do one month community service.
Justice Subramonium Prasad was dealing with a petition seeking quashing of an FIR registered against the man under Sections 354, 506 and 342 of IPC, on the ground that the parties had amicably settled the dispute.
"Looking at the facts of the case and the conduct of the petitioner, this Court is inclined to direct the petitioner to do some community service to atone for his sins. He is also warned not to repeat such actions in the future," the Court said.
The Court also imposed a cost of Rs.35,000 on the petitioner to be paid with 'Armed Forces Battle Casualties Welfare Fund'.
The allegation in the FIR was that in 2016, when the complainant went to the bathroom, the petitioner who was the landlord, came there and groped the complainant and kissed her forcefully. It was further stated that due to fear the complainant didn't make any noise and went to her room.
It was also stated that the petitioner again misbehaved with the complainant and tried to outrage her modesty.
The instant petition was filed primarily on the ground that the complainant and the petitioner had decided to settle the matter. The complainant had also filed an affidavit stating that all the disputes between the complainant and the petitioner had been settled.
Quashing the FIR, the Court ordered thus:
"In view of the above, this court is of the opinion that that no useful purpose will be served in continuing with the present proceedings. Resultantly, FIR No.334/2016 dated 03.08.2016 registered at Police Station Gandhi Nagar for offences under Section 354/506/342 IPC and the proceedings emanating therefrom are hereby quashed."
The Court accordingly directed the petitioner to do community service at Lok Nayak Jai Prakash Narayan Hospital on every Saturday and Sunday for one month i.e. from February 1 to March 2, 2022.
"He shall report to the Medical Superintendent, Lok Nayak Jai Prakash Narayan Hospital on 01.02.2022," the Court added.
It said that after the completion of one month, a certificate from the Medical Superintendent, Lok Nayak Jai Prakash Narayan Hospital, be also filed to show compliance of the order.
"In case of any absenteeism/default or any misbehaviour on the part of the petitioner, the same shall be conveyed immediately by the Medical Superintendent, Lok Nayak Jai Prakash Narayan Hospital, to the concerned SHO, who shall in turn inform the learned ASC for the State, for bringing the same to the notice of the Court and for seeking recall of the orders passed today," the Court said.
Accordingly the plea was disposed of.
