The Delhi High Court on Monday listed a fresh bail petition filed by Former AAP Councillor Tahir Hussain in connection with a Delhi Riots case (FIR 120/2020) before another bench in view of other similar pending bail pleas filed by him.
A single judge bench comprising of Justice Rajnish Bhatnagar tagged the bail plea with other pending bail petitions filed by Tahir Hussain which are listed for hearing before Justice Yogesh Khanna on August 6.
Senior Advocate Mohit Mathur along with Advocate Rizwan appeared for Tahir Hussain whereas Special Public Prosecutor DK Bhatia appeared for the State.
FIR 120/2020 registered at Dayal Pur Police Station involves offences under sec. 147, 148, 149, 427, 436 and 120B of the IPC. Apart from Tahir Hussain, the FIR names 9 other accused persons.
The FIR was registered on 4th March last year on the basis of a complaint made by one Irshad Ali wherein he stated that his rented shop was looted on 24th February last year due to the riots that erupted in the national capital. It was alleged that the shutter of his shop had been broken, articles lying therein looted and thereafter the same was set on fire by the riotous mob, as a result of which he incurred loss of around Rs.17-18.00 lakhs.
In a similar development, different benches of the High Court have issued notice on the bail pleas filed by Hussain in connection with other FIRs registered in Delhi Riots cases.
Justice Mukta Gupta had issued notice on the bail plea filed in FIR 80/2020 which was registered for the offences punishable under Sections 147/148/149/436/427/34 IPC and Sections 3/4 PDPP Act, registered at Police Station Dayalpur, Delhi.
It was the case of the prosecution that on 25.02.2020, around 100 people were standing on the terrace of the house of co-accused Tahir Hussain (main accused) and they were throwing petrol bombs on the houses of persons belonging to Hindu community.
However, at the request of Mathur appearing for Hussain to tag the bail plea along with already pending bail pleas, Justice Gupta while issuing notice on the plea listed the matter before Justice Khanna.
Justice Yogesh Khanna had earlier issued notice on the bail application and had sought Delhi Police's status report to be filed before the next date of hearing, i e. on August 6.
The bail pleas are filed in connection with two FIRs registered in relation to information received by a Trauma Centre regarding gunshot injuries sustained by Ajay Kumar Jha and Prince Bansal.
The Trial Court had in May this year denied bail to Hussain in both the FIRs after observing that it is prima facie apparent that Tahir Hussain used his muscle power and political clout to act as a kingpin in planning, instigating and fanning the flames of communal conflagration.
Additionally, the High Court has also issued notice on a petition filed by Hussain challenging the UAPA charges invoked against him in connection with the Delhi Riots larger conspiracy case and also seeking for quashing of sanction granted in this regard.
