Delhi High Court Directs Delhi Police For Report On Alleged Illegal Detaining And Beating Of Man In Matrimonial Dispute Matter

A Single Judge Bench of Justice Anu Malhotra of the Delhi High Court has issued notice on a petition alleging illegal detaining and beating of a man involved in a matrimonial dispute by the Delhi Police and directed the police to to file a status report on the incident.

The alleged incident took place at the Turkman Gate Police Post at New Delhi, and the petitioner, one Umair Siddiqui, has stated that the entire incident would have been the recorded and stored in the two CCTV cameras installed at the Turkman Gate Police Post. He submitted that the police had "illegally detained the petitioner and others and mercilessly beaten them."

Aggrieved by the police's malfeasance as well non-registration of FIR on the said incident, the petitioner therefore moved the Delhi High Court seeking an impartial preliminary inquiry and the placing on record of all CCTV footages pertaining to the incident.

Inter alia, the petitioner has also highlighted the police's non-compliance with the guidelines laid down by the Supreme Court in the case of Lalita Kumari vs Govt. of UP, wherein the court held that an FIR ought to be registered by the police where the complaint makes out the commission of a cognizable offence.

The grievance of the petitioner is that the police neither concluded the Preliminary Inquiry within the stipulated period of 15 days nor initiated any legal action against the alleged delinquent police officials nor registered any FIR on the instant complaint.

In this regard the petitioner has also prayed the court to "formulate a pragmatic mechanism to ensure strict compliance of the directions as contained in the Supreme Court judgment."
