The Delhi High Court has issued summons in a suit filed against Bollywood Filmmaker Hansal Mehta and others for restraining the release of their film 'Faraaz'.

The movie is based on the terrorist attack that happened on 1st July, 2016 in Holey Artisan, Dhaka, Bangladesh.

The suit has been filed by a family that had lost their daughters in the attack. They fear that their daughters may be shown in a bad light and hence, prayed for a permanent and mandatory injunction in their favour. The film was alleged to be violative of the their right to Privacy and right to Fair Trial under Article 14 and 21 of the Constitution of India.

Justice Asha Menon issued notice on the suit and also on the application seeking interim relief.

"The summons shall indicate that the written statement(s) to the suit and reply(ies) to the application(s) be filed by the defendant(s) within one week from the date of receipt of the summons. The defendant(s) shall also file the affidavit of admission/denial of the document(s) filed by the lplaintiff(s), failing which the written statement(s) shall not be taken on record," the Court ordered.

During the course of hearing, Senior Advocate Jayant K Mehta submitted that plaintiffs, as an interim relief, only seek a preview of the movie to be assured that their daughters are not being shown in poor light.

"The plaintiffs are at liberty to file replication(s) to the written statement(s) and rejoinder(s) to the reply(ies) filed by the defendant(s) before the next date of hearing following the filing of the written statement(s)/reply(ies)," the Court added.

The matter will now be heard on October 28.
