Delhi High Court Directs Centre To Take Decision In 8 Weeks On Establishing Separate Complex For NCLT, NCLAT

The Delhi High Court has directed the Central Government to take a decision within eight weeks in respect of the matter related to establishing separate complex for National Company Law Tribunal (NCLT) and National Company Law Appellate Tribunal (NCLAT).

A division bench of Chief Justice Satish Chandra Sharma and Justice Subramonium Prasad passed the order in the petitions filed in the year 2018 by bar associations of the two tribunals, raising grievances about several deficiencies at the existing premises.

The counsel appearing for the petitioners on October 19 submitted before the court that the Bar has been handed over a list of various plots and other buildings which are presently under construction, for developing a complex for housing the two tribunals. 

Senior Panel counsel Bharathi Raju, appearing for the Centre, submitted that the list may be handed over to her so as to enable her to forward the same to the authorities concerned for taking the decision.

"Let the same may be done. After receiving the aforesaid list, the Respondents are directed to positively take a decision within eight weeks from today," the court ordered.

Perusing the status report filed in the matter, the court also directed the Centre to consider the allotment of the entire floor of the building, where the NCLT is presently operating from to the tribunal, noting that space is now available.

"The Respondents shall also comply with the undertakings given by them in the Status Report," the court said.

The matter will now be heard on February 3, 2023.

The court in April directed maintenance of status quo with regard to the occupation, renovation or construction of the space vacated by the Ministry of New and Renewable Energy in the building where the NCLT is located.
