The Delhi High Court on Friday closed the plea filed by National President of Hindu Sant Mahasabha, Swami Chakrapani, seeking restoration of his Z security cover fearing threat from associates of Dawood Ibrahim, Chota Shakeel and other antisocial elements.
Chakrapani had alleged that his security was withdrawn by the Centre in an abrupt and arbitrary manner.
Justice Rekha Palli disposed of the plea in view of the stand taken by the Delhi Police that Chakrapani's request for upgradation of his security will be reconsidered on or before November 5, which is one month from the date of last assessment and that in case the respondents do not deem it appropriate to upgrade his security, a further review will be made within six weeks thereafter.
However, while disposing of the plea, the Court granted liberty to Chakrapani to seek appropriate legal recourse in case he still has a grievance in the future.
Swami Chakrapani in his plea has alleged that he is vulnerable to the attacks by 'associates of Dawood Ibrahim, Chota Shakeel and other antisocial and anti National elements.'
On the last date, the Court granted time to the Delhi police to revert with instructions in the matter pursuant to which an affidavit was filed wherein the copy of the latest assessment report dated 5 October 2021 was included.
Relying on the same, it was submitted by the Police that it was regularly checking the situation and has been upgrading Chakrapani's security from time to time.
It was also submitted that as per the existing guidelines, the matter is required to be reviewed after every six months. However, keeping in view the peculiar facts of the case, an enquiry was made before due date.
Accordingly, the Court was of the view that in the light of the stand taken by the police, no further orders were required in the plea.
Chakrapani has alleged that despite his representations to the respondents to maintain the 'Z' security cover in light of threats received by him, no steps have been taken in this regard.
"That it is humbly submitted that the withdrawal of the 'Z' security and downgrading the same to "X' security on 23.09.2021 may be politically motivated due to some political vendetta as the Petitioner has been vocal over various issues being faced by the society at large and Hindu religion specifically," the plea read.
The petition also stated that due to the withdrawal of Z security, Article 19 of the petitioner is violated as he has been deprived of his freedom to speech and expression and freedom to freely move throughout the territory of India as he has become vulnerable to the terrorist attacks.
"It is further submitted that it is clear from the conduct of the respondents that the respondents wish that the petitioner is eliminated at the hands of the global terrorists Daud Ibrahim, Chota Shakeel and their henchman and other anti national and anti social elements to stop the petitioner from exercising his constitutional rights of the freedom to speech and movement as well as his right to life and liberty as enshrined in the constitution of India," the plea added.
