The Delhi High Court has granted bail to a 20 year old student accused in connection with a North East Delhi riots case observing that the possibility of him tampering with the evidence was remote.

Justice Subramonium Prasad granted bail to one Dharamvir who was accused of being part of a mob which had set on fire house of one Nazmeen (complainant), looted the goods and damaged vehicles in the said house.

FIR 73/2020 was registered on February 25 last year under sec. 147, 148, 149 and 427 of IPC. The investigation revealed that there were materials against three accused, namely, Dharamvir, Arjun and Gopal.

According to the Chargesheet filed in the matter, it showed that the three were a part of a mob that had committed the offence and that Dharamvir filed an application for bail which was dismissed by the Trial Court in June this year on the ground that he was seen taking active part in the rioting and was clearly visible in the video footage.

It was therefore submitted on behalf of Dharamvir that chargesheet was filed after the order of the Trial Court rejecting bail and that he was a youngster aged 20 years.

It was further argued that the trial will take a long time and there was no necessity for keeping him in custody any further.

On the other hand, the prosecution submitted that there was every possibility of him tampering with evidence and threatening the witnesses.

"Chargesheet has been filed. The petitioner is only 20 years of age and he is a student, the possibility of the petitioner tampering with evidence is remote," the Court said while granting bail to him.

Accordingly, bail was granted to him subject to furnishing of a personal bond in the sum of Rs.20,000 with one surety in the like amount.
