A Single Judge Bench of Justice Rajnish Bhatnagar of Delhi High Court has rejected the bail application of a rape accused who  filed a fake affidavit with forged signatures and a fake Aadhar card copy of the victim claiming that the matter had been settled between the victim and him, and so the case was no longer pressed.

The order by the Single Judge noted that another FIR was lodged by the victim in this regard against the accused, and that his act "shows his desperation to come out of the jail."
The court also noted in its order that the victim was being threatened time and again to not pursue the case against the accused, for which too another FIR was lodged against the accused at the instance of the victim.
Further, in yet another FIR, the accused also faced charges of attempting to murder a witness of the victim's case on threats against her and investigation on the same was ongoing.
The prosecution submitted that a supplementary chargesheet in the matter was underway, after investigation by the Crime Branch is completed.
Holding that the allegations against the accused are grave and serious in nature, the court rejected the bail application.
The brief facts of the case are that on Aug 5, 2020 upon information through a PCR call, the police had registered the victim's case was registered through an FIR on allegations that the petitioner/accused had molested and committed rape upon her in June 2017. She had disclosed that she had joined the Eldorado Events Company of the accused/petitioner in February 2017 and that the petitioner/ accused used to take her for event meetings.
For one such meeting in June 2017 he had called the victim to Sector-9, Dwarka Metro Station, from where he picked her up in his car and gave her adulterated water to drink, after consuming which she started feeling dizzy. The alleged act of rape was committed upon her thereafter, the victim complained. She also complained that on several occasions the petitioner/ accused had passed vulgar comments about her and asked for sexual favours.
