Delhi High Court has allowed a plea moved by 69 foreign nationals related to the Tablighi Jamaat event seeking different accommodation provided the expenses of the new accommodation are borne by the foreign nationals themselves.
The Division Bench of Justice Vipin Sanghi and Justice Rajneesh Bhatnagar has further granted liberty to the concerned foreign nationals to make a representation before the Delhi Police, in case similar needs arise in future, which shall be disposed of within one week after taking permission from the Centre.
The order has come in a plea seeking modification in order passed by this court on 28/05/20 wherein the court had permitted the shifting of the foreign nationals who came to India to attend the Tablighi Jamaat conference to the several locations of their choice, since proceedings are pending against them.
The Petitioners wanted to get shifted from their present accommodation, which is an International School, to other International Schools located in other parts of Delhi with higher number of beds.
The Petitioners stated that the community shall bear all the expenses for shifting of the said 65 foreign nationals to Texan Public School and for their boarding and lodging in the said new facility.
In response to these claims, both the Centre as well as the Delhi Government did not put forward any objections.
In light of these statements, the court allowed the present petition and further directed that:
'We are of the view that for all such like modifications it should not be necessary for the parties to approach this Court. Before moving this Court, it shall be open to the petitioners to make a representation for such purpose to the Delhi Police and the Delhi Police shall, without any delay, look into any such request and if it has no objection, it shall forward the application to the Union of India along with its comments and the Union of India should then examine the request and convey its decision to the Delhi Police as well as to the petitioners. The entire process should be completed within a week of any such representation being made.'
