In a plea moved under Section 29A(5) of the Arbitration and Conciliation Act, the Delhi High Court has allowed extension of time for concluding the arbitration proceedings and passing of the award, in light of the COVID19 pandemic.

The Single Bench of Justice Navin Chawla has extended the time for the said proceedings by 6 months, after a consensus was reached between both the parties regarding the same.

Disputes had arisen between the parties with respect to the Civil and Structural Works for LLDPE/HDPE for GAIL Petrochemical Complex-II, Pata (U.P.), therefore, the Arbitrator was appointed by this Court by order dated 16/03/18.

The said Arbitrator entered upon reference on 16/04/18, and the statutory period of 12 months expired on 15/04/19.

After that, due to the non completion of arguments, the court had given two more extensions of six months each to both the parties. The last extension got over on 14/04/20.

Mr Divyakant Lahoti, who appeared for the Petitioner, informed the court that the arguments in the present matter have been concluded. However, despite the arguments having been concluded in the present matter, the connected matter pertaining to the contract of "LLDPE/HDPE Project" is yet to be heard.

He also submitted that looking into the COVID-19 Pandemic, the time for completion of Arbitral Proceeding and passing of the Award shall be extended for a further period of six months.

Since no objection was shown by the other party, the court extended the time for completion of Arbitral Proceedings and passing of the Award by a period of six months from 14th April, 2020.
