Delhi HC Denies Interim Suspension of Sentence To Murder Convict Who Wished To Remarry 'To Fill Colours In His Lonely Life' [Read Order]

While denying relief, the Division Bench of Justice Vipin Sanghi and Justice Rajnish Bhatnagar observed that:

'Since the appellant is undergoing life sentence, his desire to get married cannot be a reason to grant him interim bail. The present is the case where the appellant has been found guilty of murdering his own wife and his minor child was an eye-witness to the offence. He also made an extra judicial confession of his crime before his son-in-law soon after the crime.'

In his petition, the said convict had stated that he is 45 years of age and he wants to get married again to fill colours in his lonely life.

He further submitted that he does not wish to live lonely any further and he wishes to start his family life.

The Petitioner also submitted that he is having agricultural land, and since his arrest in the present case, he could not visit his native village to see his land.

Countering these claims, the status report filed by the state mentioned that the appellant is not having any agricultural land. In fact, his daughter has made a statement to this effect that he has already disposed of the land that he owned. There are three other sons of the old parents for looking after them and, therefore, the presence of the appellant is not required to look after them.

It was further submitted by the Additional Public Prosecutor that the minor son subsequently committed suicide due to his mother being murdered by his own father.

In light of these facts, the court denied interim suspension of sentence to the Petitioner.
