The Delhi High Court has denied anticipatory bail to a man who allegedly pretended to be a Major in Indian Army on a matrimonial website and entered into sexual relations with a woman on a false promise to marry her, despite being married to another woman.

Observing that the man prima facie duped the woman for entering into a relationship, Justice Anu Malhotra said:

"Taking into account the totality of the circumstances of the instant case which bring forth also through the submissions made now on behalf of the applicant by learned counsel for the applicant that the applicant was apparently not working as a Major with the Indian Army and that thus, it is prima facie apparent that the prosecutrix prima facie appears to have been duped for entering into relationship with the applicant and thus the application seeking grant of anticipatory bail is declined."

The allegations against the man were that the woman had undergone abortion last year after she had informed him of her pregnancy. 

It was also alleged that he had promised her that he would get jobs for her relatives and family members for which money was paid by her in terms of four cheques for sums of Rs.15 to 20 lacs.

It was also the case of the woman that the man had threatened her of making her photographs with sexual contents viral on social media, which were taken by him without her consent, thereby defaming her. 

On the other hand, seeking Anticipatory Bail, the man had argued that the relationship between the two was completely consensual and that the alleged monetary transaction was only a civil transaction, qua which, the proceedings in a Civil Court can be initiated by the prosecutrix.

It was also submitted that the contents of the FIR did not disclose commission of rape as offence punishable under sec. 376 of the Indian Penal Code, 1860.

It was also submitted by the man that he was working earlier with the CRPF and was presently working in a private company.

Looking at the facts of the case, the Court dismissed the anticipatory bail plea.
