Delhi Court Seeks Police Report On Brinda Karat's Plea For FIR Against Anurag Thakur & Parvesh Verma For Hate Speech
A Delhi Court on Wednesday directed Delhi Police to file an Action Taken Report (ATR) in a plea seeking registration of FIR for the offence of hate speech against Union Ministter Anurag Thakur and BJP leader Parvesh Verma. A Delhi Court on Wednesday directed Delhi Police to file an Action Taken Report (ATR) in a plea seeking registration of FIR for the offence of hate speech against Union Ministter Anurag Thakur and BJP leader Parvesh Verma.
ACMM Vishal Pahuja at Rouse Avenue Court passed the order in a petition moved by CPM leader Brinda Karat, under section 156(3) of the Criminal Procedure Code. The case will be next considered on February 11.
In her petition, Ms Karat has sought the following remedies from the court:
- Direct the SHO of Parliament Street Police Station to register an FIR on the complaint dated 29/01/2020 alleging commission of offences under sections 153A, 153B, 295A, 298, 504, 505 and 506 of the Indian Penal Code
- Direct that the investigation into the FIR be monitored by issuing necessary directions to the SHO to investigate the matter fairly, properly and impartially after registration of the FIR, including the arrest of the accused.
The court has issued the said direction to the Deputy Commissioner of Police, Delhi.
Last week, the Election Commission of India had ordered the removal of Anurag Thakur and Parvesh Verma from the list of star campaigners of Bhartiya Janta Party for the general elections to the Legislative Assembly of the NCT of Delhi with immediate effect and until further orders.
This was for their campaign speeches, which were found to have the effect of disturbing communal harmony, resulting in the violation of Model Code of Conduct and the provisions of Representation of Peoples Act.
The Commission had earlier issued show cause notice to Thakur in respect of his comments inciting the crowd to gun down 'traitors' during an election rally. ECI took objection to the Thakur's remark "desh ke gaddaron ko", which incited the response "goli maaron saalo ko" from the crowd.
In the notice, the poll panel expressed the prima facie view that the remarks had the potential of "disturbing communal harmony and aggravating the existing differences between social and religious communities".
The action against Parvesh Sahib Singh, a BJP MP, was for his controversial statements against the persons protesting at Shaheen Bagh against CAA-NRC.
