Court Seeks Delhi Police's Action Taken Report On Sameer Wankhede's Complaint Against IPS Officer Gyaneshwar Singh

A Delhi Court has sought an action taken report from the Delhi Police on the complaint filed by IRS Officer Sameer Wankhede against IPS Officer and NCB DDG Gyaneshwar Singh.

Wankhede has sought registration of an FIR against Singh under the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities ) Act, 1989. He has alleged that Singh harassed him during the enquiry conducted to probe the alleged procedural lapses by him in connection with the Cordelia cruise drugs case.

Additional Sessions Judge Devender Kumar Jangala of Patiala House Courts issued notice to the Deputy Commissioner of Police (South West District, Delhi) and ordered that an action taken report be filed in respect of Wankhede's complaint made to the Mumbai Police.

The matter will now be heard on February 06.

The Mumbai Police had written a letter to Wankhede in December last year informing him that his complaint was transferred to the Delhi Police for further necessary action.

Wankhede moved the court by filing an application under Section 156(3) of Cr.PC alleging that Singh committed the offences punishable under Section 3(1)(p), 3(1)(r), 3(1)(u), 3(1)(v), 3(1)(zc) of SC & ST(Prevention of Atrocities) Act.

It is his case that he is member of Scheduled Caste community and therefore, is entitled to claim protection granted under the enactment.

Wankhede told court he sent various emails to the Deputy Commissioner of Police (South West District, Delhi) for further action but neither any action was taken nor FIR was registered against Singh.

A Special Enquiry Team (SET) was constituted by NCB's Competent Authority to enquire into the allegations levelled against him in the manner he conducted the raid on the cruise.

On August 21 last year, the Central Administrative Tribunal had observed that Gyaneshwar Singh, being actively involved in the investigation could not have been part of the SET, and directed that an opportunity for a hearing be given to Wankhede before taking any action.

It was Wankhede's case that Singh went beyond the scope of the enquiry and humiliated him for being a member of schedule caste.
