A Delhi Court has recently sought action taken report on the two complaints filed against Karni Sena Chief, Suraj Pal Amu and Dasna Devi Temple's Priest, Yati Narsinghanand Saraswati over their alleged "communally provocative and divisive remarks" against the Muslim community.
Filed by a law teacher namely Faizal Ahmed Khan through Advocates Sarim Naved, Kamran Javed and Anshu Davar, the criminal complaints seek direction on the SHO, Jamia Nagar police station to register FIRs against the two for making statements with the intention of outraging the religious feelings of Muslim community, promoting feelings of enmity, hatred and ill-will between the Hindu and Muslim communities and also for causing fear and alarm among persons belonging to the Muslim community.
Metropolitan Magistrate Rajat Goyal sought response of the SHO by way of an action taken report as to whether any complaint was filed by the complainant in the concerned police station and whether any action had been taken on such complaint if so filed.
"Whether any Investigation or inquiry has been conducted in this regard and if yes, then what is the status of the investigation/ inquiry?" the Court added.
The Court has also asked the SHO to file response as to whether any FIR has been registered in case any cognizable offence has been made out in the matter.
The said action taken report has been sought till September 27.
Complaint Against Karni Sena Chief, Suraj Pal Amu
The complaint places reliance on the alleged communal remarks made by Suraj Pal Amu in May and July this year at two mahapanchayats organised in Haryana's Pataudi town.
It has been alleged that the speeches were made with the intention of outraging the religious feelings of Muslim community and also to disturb peace.
Furthermore, it has been stated that the speeches were made in the presence of cameras, with the awareness that they would be published, circulated and viewed by people across the country.
The complaint seeks registration of a First Information Report (FIR) under sec. 153, 153A, 153B, 295A, 298, 504, 505(1) , 505(2) and 506 of the Indian Penal Code.
It has also been alleged that the concerned SHO refused to receive copy of the complaint letter submitted by the complainant for registration of FIR against Amu and that no action was initiated against him in the matter.
"Amongst other remarks, the Accused urged the crowd to murder Muslims, take revenge against them for the loss of lives during Partition and murder those who enter into interfaith marriages," the complaint reads.
"The Accused has openly used words and phrases such as 'Pakistani kutton', 'Pakistan ki aulaad', 'kasaayi' and 'love jihad' against the target group, that is, the Muslim community, since these are words and phrases generally considered to be offensive to the said community and objectively offensive to the society as well," it added.
Complaint Against Dasna Devi Temple's Priest, Yati Narsinghanand Saraswati
The complaint places reliance on an interview/press interaction in Aligarh, Uttar Pradesh in July given by Narsinghanand alleging that he said that persons studying in certain educational institutions "cannot bear true faith and allegiance to the Constitution of India or uphold the sovereignty and integrity of India".
".. the Accused intentionally insulted prominent central universities like Aligarh Muslim University (hereinafter referred to as "AMU") and Jamia Millia Islamia, clearly aiming to target the Muslim community as these institutions are popularly associated with the Muslim community in terms of their establishment as well as the fact that their current administrators are largely Muslims, and Islamic educational institution Darul Uloom Deoband by advocating their bombing," the complaint reads.
Furthermore, the complainant has alleged that Narsinghanand called for a total boycott of Muslims, their religious texts and a "nation free/ devoid of Islam or anything associated with it."
The complaint sought registration of FIR under sec. 153, 153A, 153B, 295A, 298, 504, 505(1), 505(2) and 506 of IPC.
"Accused urged the crowd to bomb the AMU for producing anti-nationals and destroy all the places of worship of Muslims," the Complaint adds.
