Delhi High Court Bar Association has come up with a scheme to provide ex gratia relief to advocates who have been severely affected by the nationwide lockdown and restrictive functioning of the courts.
The resolution for the scheme was unanimously passed on April 3, in an executive committee meeting which took place through video conferencing. The scheme will be implemented from April 6.
As per the resolution, the object of the scheme is to provide immediate and effective succour to the members of the DHCBA who have been adversely affected, in the terms of finances, due to the outbreak of COVID19 and the nationwide lockdown ordered to curb the same.
The resolution has created a fund to support the scheme and have asked the senior members of the Bar, members with established practice, and law firms to contribute to the same.
Names of the donors will be displayed on the website of DHCBA unless otherwise specified by the donor.
In addition to this, DHCBA would be earmarking a special budgetary allocation for this corpus from its existing funds.
The ex gratia amount will be given to the members falling in the following categories:
- Members having 0-7 years standing as Advocates and who are 32 years of age or below
- Members whose family/household income was equivalent or less than 6 lakhs per annum in the preceding 12 months
- Members in need of money to defray urgent and unavoidable medical expenses for themselves or their family members
- Members in dire need of funds to meet exceptional hardships
A member would not be entitled for an amount more than ₹10,000.
This scheme has no nexus with any similar scheme taken out by either the Bar Council of Delhi or any other association of advocates.
