The Central Government today notified the transfer of Justice Birendra Kumar, Judge, Patna High Court to Rajasthan High Court.
Justice Birendra Kumar was born on 23rd May 1963. He completed his LL.B. degree from Patna Law College, Patna in the year 1986. He practiced in various Civil and Criminal Matters in Patna Civil Court and Patna High Court.
Justice Kumar Joined Bihar Superior Judicial Service as Additional District & Sessions Judge in the year 1997. He also held the office of Registrar General, Patna High Court from the year 2011 to 2014.
Before his elevation, he was posted as District and Sessions Judge, Patna. He was elevated as an Additional Judge of Patna High Court on 16th November, 2016.
The Supreme Court Collegium, in its resolution dated October 28, recommended his transfer from Patna High court to Rajasthan High Court.
In July this year, while acquitting an accused in a POCSO case, he had held that the evidence of approximate age of the prosecutrix cannot take the place of proof of exact age.
Observing that a Trial Court Judge referred to Sanskrit shloka and ghazals of Late Jagjit Singh while awarding sentence to a man convicted under the POCSO Act, he had observed that the trial judge "needs special training at the Judicial Academy."
In March 2021, his bench had observed that in absence of any connection between the act alleged and the property recovered under the Unlawful Activities (Prevention) Act, it cannot be assumed that those properties were acquired by the terrorist act.
