The Bombay High Court on Thursday directed extension of all interim orders relating to eviction, demolition and dispossession by the High Court as well as subordinate courts in Maharashtra and Goa till December 22.

Chief Justice Dipankar Datta, Justice AA Sayed, Justice SS Shinde and Justice KK Tated was hearing a suo motu petition regarding access to justice system for the poor and marginalized during the pandemic along with an interim application seeking some modification of previous orders extending operation of orders relating to eviction, possession and demolition.

Court observed-

"Although the situation in the State of Maharashtra because of the pandemic has improved over the last few days, access to the courts of law is yet not free. To ensure that persons suffering orders of dispossession, demolition, eviction, etc., passed by public authorities are not inconvenienced by reason of disability to approach the Courts of law because of the restrictions as to movements imposed by the State Government as well as the requirement to maintain social distancing norms, we consider it just and proper to extend the interim orders passed by this court on this writ petition till 22nd December, 2020 or until further orders, whichever is earlier."

The matter will now be listed for hearing on December 22, as the winter vacations for the Bombay High Court start from December 23.

Previously, while extending such orders till October 31, and refusing Pimpri Chinchwad Municipal Corporation's plea to implement an order by NGT which would result in removal of encroachments near river beds. Court had observed that no one can be allowed to be rendered homeless during the pandemic and that all high courts across the country have passed similar orders against eviction demolition, dispossession etc in view of the pandemic.
