The Bar Council of Rajasthan, through the Bar Council of India Advocates Welfare Fund Committee for the State, has announced that it will transfer Rs. 5000 to Advocates in need of Financial Assistance during the lockdown period.

The Council has thus called for applications from distressed Advocates, latest by May 3, 2020.

The stipulated amount will be credited directly to the accounts of needy advocates found eligible as per the following criteria:

  • The applicant must be enrolled with the Bar Council of Rajasthan and should have a real and active practice;
  • The applicant should've passed AIBE mandatorily within stipulated period and must enclose/refer passing acknowledgement;
  • Applicants should have submitted Certificate and Place of Practice under Certificate of Practice Rules, 2015;
  • The applicant should not be in receipt of any monthly payment from the Advocate to whom he/she is junior, as certified by his/her Senior Lawyers;
  • The applicant was not earning monthly income Rs.10,000/- as on the relevant date.
  • The applicant is finding himself in great difficulty for his/her livelihood or for purchase of medicine or regular treatment due to extraordinary situation;
  • If Advocate/Applicant is residing in the rented accommodation, he/she should be submitted a rent agreement or self attested affidavit;
  • The spouse of the applicant should not been an employee;
  • Advocate-applicant/applicant's spouse should not have either immovable properties and four wheeler;
  • Advocates enrolled after retirement from any service/ Income Tax Assesses are not eligible under this Scheme;

The Bar Council has directed all the concerned Bar Associations to constitute a Committee which shall scrutinize all the applications and prepare a merit list and send the same to the Bar Council of India Advocates Welfare Fund Committee for the State of Rajasthan for further consideration.

It has been cautioned that if any applicant furnishes false particulars to avail the benefits under this scheme, the Bar Council will initiate disciplinary action against such person under section 35 of the Advocates Act, 1961, in addition to recovery of the amount with penalty.

Pursuant to this, the Rajasthan High Court Bar Association, Jaipur has called for applications from all eligible Advocates latest by May 2, 2020.

The entire communication process will be conducted though email, addresses for which are mentioned in the Notification, and the Advocates have been requested to not to travel to RHCBA Jaipur office.

The Association has also asked all the applicants to ensure that they do not submit their application through more than one Bar Association.

The Bar Council of Delhi had also decided to provide financial assistance of Rs. 5,000 to Advocates in need. Similarly, the Bar Council of Tamil Nadu and Puducherry had also resolved to extend financial assistance to all those needy advocates, who are unable to meet their day to day expenses due to the lockdown.

Recently, the Bar Council of West Bengal also informed the Calcutta High Court during hearing of a letter petition that it has decided to provide financial assistance to needy lawyers.
