A prime accused in the solar panel scam has moved the Kerala High Court challenging the bail granted to former MLA PC George in the sexual harassment case.
PC George was arrested by the Cantonment Police from Thiruvananthapuram on Saturday based on a complaint alleging that he sexually harassed the accused in the solar panel case at a guest house. Upon reaching the guest house, it is alleged that George advanced certain unwelcome and explicit sexual overtures to the de facto complainant.
Shortly after his arrest, George was released on bail by a Magistrate on the condition that he cooperates with the investigation.
In her petition preferred through Advocate B.A. Aloor, the petitioner has alleged that George repeatedly called her on her mobile phone and invited her to his guest house with the intention to outrage her modesty.
The petitioner contends that in February 2022, George subjected her to physical and mental harassment by sexually abusing her at his guest house. It is also submitted that she was undergoing treatment for her ailments till June, justifying the delay in filing the complaint.
According to the plea, the incident came to light after she disclosed the same before a Chief Judicial Magistrate in relation to another crime. An FIR was subsequently registered against George on 2nd July and he was arrested on the same day.
However, he was soon released on bail by the Magistrate. This order of the lower court has been challenged as wrong, illegal, and against criminal jurisprudence.
The plea states that George should be subjected to a detailed custodial interrogation and that the bail order was issued without going into the entire allegations against him. It has also been submitted that there are no reasonable grounds to disbelieve the allegations against the former MLA or to presume that they are not well-founded.
The petitioner has argued that the entire investigating agency was influenced by the accused and that he himself has been approaching the petitioner with an ill motive to make her withdraw the complaint against him after he was released on bail. It has also been submitted that the accused has antecedents and that incriminating circumstances can be found against him.
Accordingly, it has been prayed that the bail granted to the former MLA be quashed and set aside and that he may be directed to be sent to judicial custody.
