While cancelling bail granted to an accused (Farhan) in the 2005 murder of then BSP legislator Raju Pal in Prayagraj, the Allahabad High Court observed that in the area of the Police Station Dhomanganj/Dhoomanganj, Prayagraj the writ of the State Government does not run, rather, the writ of dreaded criminal, Ateeq Ahmad runs.
The court observed thus as it noted that both Raju Pal and the star witness of the murder case, Umesh Pal (killed last month) were eliminated by assailants acting allegedly at the behest of Former MP Atique Ahmed.
"...recently one star witness of Raju Pal's case got eliminated in a most gruesome and dare-devil manner allegedly by Ateeq Ahmad and his gangmembers in a broad-day-light incident. All the offences are registered at Police Station Dhomanganj, Prayagraj. It appears that in the area of Police Station Dhomanganj, writ of the State Government does not run, rather writ of dreaded criminal, Ateeq Ahmad runs," the bench of Justice Dinesh Kumar Singh observed.
Essentially, the Court was dealing with the bail cancellation plea moved by Umesh Pal (who was killed last month) wherein it observed that Accused Farhan is a hardened criminal who belongs to one of the most dreaded gangs of Uttar Pradesh led by the accused, Ateeq Ahmad.
The Court also noted that after he was set at liberty of bail granted by the trial Court in the murder case (wherein Sitting MLA Raju Pal and his two Security Guards were killed in a broad-day-light), he committed one offence after another of heinous nature.
Accused Farhan was granted bail by the Sessions Judge, Allahabad in the year 2005, however, after his release on bail, his name appeared as accused in 25 cases, including three offences under Section 302 IPC, three offences under Section 364 IPC, two offences under Section 307 IPC and offence under Section 376-D IPC.
Taking note of the cases against him, the Court observed that he not only violated the terms & conditions of the bail but also he has been involved in several offences, including three cases of murder.
Consequently, finding that the accused-respondent would be a danger to the witnesses and his freedom would be in peril to the lives, safety and security of the law-abiding citizens and witnesses, the court cancelled his bail.
