A plea has been moved before the Allahabad High Court seeking direction to the Union Of India to decide Petitioner's representations regarding declaration that there is no need to vaccinate those who have Corona antibodies developed in them.

The plea has been filed by the Rashtriya Rashtravadi Party and others have submitted in their plea that those who got Corona antibodies developed in themselves in various ways and for various reasons may be excluded from the compulsory vaccination program.

Referring to the statements of the officials of the Indian Council for Medical Research, New Delhi, the plea avers that while the good level of Antibodies develop in all those who have been given Covid vaccine but only 80 percent of them develop the required immunity from Covid, while 20 percent do not develop the required immunity.

Further, the plea also refers to a group of public health experts, which includes doctors from AIIMS and the members of Covid-19 national task force, who have suggested that there is no need to vaccinate people who had documented Covid-19 infection.

Further, referring to the media reports, the plea submits that the Covid antibodies seem to remain active and developed for many months and possibly for years in those who got Corona positive and got cured.

Based on the above facts, the plea has concluded that-

  • It might be too hurried to decide that all persons must necessarily get corona vaccinated by the presently prevailing and available Corona vaccine only.
  • Those who got Corona antibodies developed in themselves in various ways and for various reasons might be excluded from the compulsory vaccination program, at least till the time when the vaccine development process gets finally crystallized and a definite and final opinion in this regard gets universally settled and accepted.

The plea also submits that there does not seem to be any need for vaccination in all those cases, where corona antibodies have already got developed because of various reasons.

The plea prays that directions be issued to the Union of India to decide the petitioner's representation as per facts and merit of the case and to issue appropriate directions/guidelines about whether there is a need to vaccinate those who have Corona antibodies developed in them or not.
