The Allahabad High Court on Wednesday issued a notice to the Uttar Pradesh Government and sought its counter affidavit on a plea filed against the alleged disputed statements of former Shia Waqf Board chairman Wasim Rizvi (now known as Jitendra Narayan Singh Tyagi).

Importantly, the plea before the Allahabad High Court seeks a direction to restrain Rizvi (now known as Jitendra Narayan Singh Tyagi) from giving disputed religious statements in social media or electronic media. The plea also seeks a direction to restrain him from raising questions on/against Prophet Mohammad and Holy Book Quran.

Hering the matter on December 22, the Bench of Chief Justice Rajesh Bindal and Justice Piyush Agarwal issued a notice to the UP Government as well as Rizvi seeking their response in the matter. The matter would be heard next on April 13, 2022

Background of the plea.

The plea has been filed by one Mohammad Yusuf Umar Ansari, Secretary of Hazrat Khwaja Garib Nawaz Association through Advocate Saher Naqvi and it goes on to allege that Rizvi has been continuously making controversial statements regarding Muslim religion, thereby spoiling the atmosphere.

Further, the plea also seeks deletion of hate speech and posts of Rizvi from Social Media or Electronic Media and it also seeks a direction to the State Government of Uttar Pradesh to take legal action against him alleging that he is doing anti-national work.

Importantly, referring to his book Titled 'Mohammad', the plea states that he has mentioned several disputed points in his book that are harmful to the peace and security of society. The plea also claims that he has also given many disputed religious statements on Social Media as well as on several platforms.

Lastly, claiming that Rizvi is a criminally minded person and anti-social element for the society and that 27 cases have been lodged against him under severe sections, the plea further prays thus:

"...it is humble prayed before the Court to restrain (him) from giving harsh statement which can harm the National-wide or International, it is further stated that as he is given some irrespective statement regarding Quran in his book which is not justified for the internal society as the Quran is an international book many Islamic Persons have faith upon this book and each Islamic Country of the world is purely following the book Quran and nobody can harm the contents of the books. By his statement peace and harmony can be disturbed."

In related news, the Uttarakhand Police on Thursday lodged a case against Jitendra Narayan Singh Tyagi, formerly known as Waseem Rizvi, and others for allegedly giving a provocative speech against a particular religion at a "Dharma Sansad" or religious assembly which was organized in Haridwar in Uttarakhand on December 17-19.
