The Allahabad High Court recently granted bail to a man (named Sujeet Sharma) accused of making a video abusing the Chief Minister of the state, Yogi Adityanath, and sharing the same on WhatsApp.
The order was passed by the bench of Justice Ajay Bhanot after the counsel for the accused made a submission that the accused holds constitutional dignitaries in the highest regard and that he did not have any intention of insulting high constitutional dignitaries.
It was also submitted before the Court that the accused was induced into drinking by the co-accused persons and may have blurted out some objectionable words under the influence of liquor and that the video was captured and circulated without his knowledge and consent.
In view of these submissions, the bench directed that the accused Sujeet Sharma be released on bail on furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court below.
It may be noted that the accused had been booked under Sections 504, 506, 386 IPC, Section 66 Information Technology Act, and Section 3/25 Arms Act and was arrested in October 2022.
As per the FIR in the case, a copy of which has been accessed by Live Law, a piece of information was received by the Kushinagar Police personnel that a video made by Sharma abusing the Chief Minister of the State was getting viral on social media. Pursuant to this, the FIR was lodged against him on October 7, 2022, and he was arrested on October 22, 2022.
