The Gujarat High Court Advocates' Association has on Saturday written to the Chief Justice of the Gujarat High Court seeking immediate resumption of physical functioning of the Courts without any further delay. It has stated that if their request is not acceded to, the Managing Committee will stage a protest on 19th February 2021 at 10.30a.m. at entry gate of the High Court.

The Managing Committee of the Association held a meeting on Saturday and unanimously resolved to request that physical functioning of Courts be resumed.

The letter has asked the Chief Justice and the Judges to consider that the State election commission has announced election to all local bodies which will be conducted in this month and will involve almost 45 million residents of Gujarat. The Association believes that they must have taken a clearance from several authorities including the Police Chiefs, Collectors, Medical Officers, Doctors, etc before deciding to go ahead with the election.

Since the State Government is essentially concerned with the Safety, Health and Security, the SEC must have decided to hold the election only if the state government feels that atmosphere is conducive to hold the elections. It can also be safely and reasonably presumed that the pandemic of Covid 19 must have been discussed in great details, before taking the decision to hold the elections.

The letter has further stated that 5-7 cricket matches between India and England will be hosted at Ahmedabad and will place at Motera Stadium, which has a capacity to host 1,15,000 spectators. The spectators have also been permitted to watch the match with half capacity of the stadium by the administration.

Through its letter, the Association has also informed the Chief Justice that several representations have previously been made to request resumption of physical hearings, but the request has not been acceded to. A request letter was also forwarded to the Chief Justice and other Judges of the Court signed by the Bar Presidents of four metros citing various illustrations to persuade the to start physical functioning of the courts.
