The High Court of Madhya Pradesh has granted anticipatory bail to a man accused sharing a morphed picture of Prime Minister of India in a WhatsApp group after he apologized to the complainant.

The FIR was lodged against Arvind Jorge Claudius after a man complained about a message on a WhatsApp group which contained an objectionable photograph of PM Narendra Modi touching a female (morphed image) inappropriately.

The court granted bail to the man who was accused of sharing it after he gave a written apology to the complainant and others so affected. The complainant thereafter wrote to the police that he is no longer desirous of prosecuting the case against him.

However, the state protested the granted of bail by saying that the letter of pardon given by the complainant does not change the texture of the case where the offence is a grievous one having shown the Prime Minister of this country in a poor light.

The court observed that as the complainant himself has forgiven the applicant, herein being satisfied that the penitence of the applicant is genuine, it is inclined to grant bail.
