The All India Muslim Personal Law Board (AIMPLB) on Monday told the Supreme Court that it would issue an advisory to ‘Qazis’, requesting them to advice the bridegrooms against resorting to triple talaq to annul their marriage. The Board also decided that those who resort to triple divorce in one go leading to the creation of problems thereafter should be boycotted by the Muslims.

In the affidavit submitted to the Apex Court, the AIMPLB has also told the Court that it would request the Qazis to advice the bride and the bridegroom to incorporate a condition in the ‘Nikahnama’ to exclude resorting to triple talaq, “sitting since it is an undesirable practice in Sharia”. The advisory, it said, would be issued through its website, publications and social media platforms.



The Board further placed on record certain resolutions passed by its Working Committee in meetings held earlier in April. The Board had then resolved to convey a code of conduct/guidelines to be followed in the matters of divorce, particularly emphasizing on the need to avoid pronouncement of three divorces in one sitting.

“The stand of Shariat is clear about divorce that the pronouncement of divorce without any reason and that three divorces in one go are not the correct methods of pronouncement of divorce. Such a practice is strongly condemned by the Shariat. That is why the All India Muslim Personal Board will start a grand public movement for desisting the people from pronouncing divorce without any reason and that in case of necessity only one divorce should be resorted to and in any case three divorces in one go should not be resorted to. Every effort should be made to convey this message to all the segments of Muslims especially to the poor population and the help of Imams and orators of the mosques should be called for (sic),” the resolution stated.

It had further resolved to boycott those who resorted to the practice, hoping that such “social boycott will be much helpful in decreasing the incidents of divorce.” It had also issued guidelines to be followed by the husband and wife in times of a dispute.

The affidavit would be perused by a five-Judge Constitution Bench of the Apex Court, which had on May 18 reserved its verdict on several Petitions which had challenged the Constitutional validity of triple talaq.
