[Advt.] NLU Odisha: Triple Credit Course On Maritime Law And Practice [Register By 20th December]
The National Law University Odisha, Cuttack (NLUO) established the Centre for Maritime Law in 2015 with an aim to build a centre of excellence and research in the field of maritime law in India. The Centre identifies first and foremost, that the statutes which govern maritime law were adapted from foreign states and these statutes don't address the concerns pertaining to the field appropriately, as the Indian trade practices are relatively different from those foreign states. Also, under the Indian maritime law regime, there has been a lack of timely amendments and proper implementation and hence most of the laws are outdated and are not equipped to deal with modern complications. The Centre is currently working on Indian statutes, case laws, international treaties and conventions pertaining to maritime law and seeks to crystallize the current maritime jurisprudence in India.
Overview of the Course
Maritime law or admiralty law plays a significant role in the smooth conduct of global trade, settling disputes and ensuring safety at sea. Given that maritime activity has become increasingly important to the economy of nations around the world, the curriculum is vast in its scope and includes shipping contracts and marine insurance, as well as the mechanisms provided by the United Nations Convention on the Law of the Sea (UNCLOS) for resolving international disputes.
This course is a well-designed program that gives participants a comprehensive understanding of the intricate legal frameworks ruling over maritime commerce, insurance, etc. The course consists of five comprehensive modules, aimed at equipping participants with a strong 45-hour course, combining the foundational theories with the practical applications in order to create a valuable resource for the legal professional, the student, and the stakeholders of the maritime industry.
Participants will be exposed to the legal principles underlying maritime operations and how such principles are therefore applied in practice. The course comprises five separate modules, which focus on the critical elements of maritime law:
1. Law of Carriage of Goods by Sea: This segment introduces participants to the fundamentals of contracts, the role of bills of lading, and the application of international conventions such as the Hague and Rotterdam Rules.
2. International Law and the Law of the Sea: Participants delve into the historical evolution of maritime law, explore concepts like baselines, maritime zones, and environmental protection, and analyse dispute resolution under UNCLOS.
3. Law of Shipping Contracts: Focused on operational agreements, this module covers principles of salvage, towage, and maritime labour laws, including the Maritime Labour Convention, 2006.
4. Law of Marine Insurance: This module unpacks the complexities of marine insurance, covering topics such as utmost good faith, loss indemnification, and standard clauses like the Institute Cargo Clauses.
5. Law of Maritime Dispute Resolution: With a focus on both litigation and alternative dispute resolution, this module explores claims under the Admiralty Act, 2017, and arbitration in maritime contexts.
The course schedule is tailored to accommodate participants' diverse needs, with weekday and weekend classes offering flexibility. Experienced faculty, including Advocate Aishwarye Dubey, a seasoned maritime legal consultant, and Captain Alex Antony, a Master Mariner, bring a wealth of academic and professional expertise to the program.
Participants will be assessed through an online examination, ensuring a rigorous evaluation process.
Of all those who participate in this course, the top two performers, upon evaluation, will have the opportunity to intern with prestigious law firms, viz. Callidus Legal and VJ Mathew & Co., respectively.
This program is not just an academic venture; it is a gateway to the dynamic world of maritime law. Whether you aim to specialize in maritime litigation, explore international trade law, or understand the nuances of marine insurance, this course equips you with the skills and knowledge to navigate the maritime legal landscape confidently.
At the end of the course, the students will get a certificate of completion and a grade sheet. Based on internal rules in their respective institutions, the students may be able to use this as part of the Choice Based Credit System and utilize the credit as part of the requirements of the degree they are pursuing.
Scope and Limitation of the Course
The course provides a solid foundation in maritime law, emphasizing practical aspects essential for handling everyday legal matters in the maritime industry. Its scope is broad enough to include international law, maritime insurance, dispute resolution, and labour conventions, but it is not designed for specialization in niche areas like piracy or advanced maritime boundary disputes. Participants desirous of in-depth knowledge in specific areas of maritime law may need to pursue additional specialized training.
