Allahabad High Court provides relief in a FIR Registered against the co-founders of Cars 24

In a big relief to the co-founders of the Cars 24 Services Ltd., the Allahabad High Court issued an order to stay any coercive against the co-founders of the company till next three months in a case related to the sale of forged documents pertaining to a pre-owned car. The co-founders of the company were represented by Karanjawala & Co.

The FIR has been registered against the co-founders under Sections 405, 420, 467, 471, 504, 506 and 120-B IPC. Essentially, the case against the co-founders was that a dealer has bought a car from the website of the Cars 24 company which later found out to be already hypothecated with a bank. The dealer then lodged a complaint against the co-founders of the company.

Senior Advocate Navin Sinha along with Advocate Ritu Raj local counsel Raghuvansh Misra appeared on the behalf of the co-founders and argued that the Company has only acted as an intermediary between the original seller and the dealer and it had no role in making any documents. Furthermore, it was submitted that the co-founders were nowhere involved in the entire transaction and the case against the petitioner is an abuse of the process of law, especially when the Company is not even arraigned as an accused in the FIR. It was also clarified that as soon the Company came to know about the forged papers, it had asked the Dealer to return the vehicle and take its money back which clearly shows that there was no criminal intent on the part the Company.

Accordingly the bench of Justice Ashwani Kumar Mishra and Justice Rajnish Kumar stayed the arrest for the next three months and also issued notices to all the parties to settle their dispute.
