Chandhiok & Mahajan Successfully Defends Intel Corporation In An Abuse Of Dominance Investigation

New Delhi, Delhi: Intel Corporation, an American multinational corporation, is a global technology company that manufactures chips, boards, and other semiconductor components.

In 2018, the Competition Commission of India (CCI) initiated an investigation against Intel for abusing its dominance by allegedly denying access to files that may be necessary for developing server board designs based on a specific server platform launched by Intel. The investigation was initiated following a complaint filed by an Indian company.

On 03 December 2021, the CCI closed the investigation after concluding that Intel has not abused its dominance. In support of its analysis and conclusions, the CCI relied on detailed submissions made on behalf of Intel as well as the findings of the investigation report submitted by the Director General. The investigation report had ruled out any denial by Intel to give access to files, as claimed by the complainant.
