Bombay High Court Inter Alia Challenging The Action Taken By State Bank Of India On Mr. & Mrs. Goyal
Mr. & Mrs. Goyal filed two separate writ petitions before the Bombay High Court inter alia challenging the action taken by State Bank of India against Mr. and Mrs. Goyal under the RBI Master Circular on Fraud. The said Petition(s) were listed today before the Division bench comprising of their Lordship the Hon'ble Mr. Justice S.V. Gangapurwala and the Hon'ble Mr. Justice Madhav J. Jamdar
Senior Counsel Dr. Mr. Milind Sathe, a/w Naval Agarwal alongside Mr Ameet Naik Founder and Managing Partner, Naik Naik & Co. appeared for Mr. Goyal and Senior Counsel Mr. Navroz Seervai alongwith Naik Naik & Co. appeared for Mrs. Goyal. Adv. Aditi Pathak from Bombay Litigation and Corporate Company appeared for Reserve Bank of India ("RBI") and Adv. Rathina Maravarman appeared for State Bank of India ("SBI").
When the Petition(s) were called out, Advocate for SBI requested time to file Reply. Dr. Sathe and Mr. Seervai insisted that meanwhile no further steps be taken by the Respondents. The Counsels for the Petitioner gave reference to Telangana High Court order, Supreme Court's order passed in Telangana High Court's matter and Bombay High Court's order, whether interim reliefs were granted. After hearing the advocates, the Court granted SBI two weeks to file Reply and meanwhile directed Respondents not to take any further steps pursuant to the order under criminal law.
