The Centre has notified the appointment of Gujarat High Court judge, Justice MR Shah as the Chief Justice of Patna High Court.
Justice Shah enrolled as an advocate in July 1982 and was elevated to the Bench in March 2004. He was confirmed as a permanent judge of the court in June 2005.
He had first been recommended to be transferred from Gujarat High Court in February 2016, during Chief Justice TS Thakur’s tenure. However, it has time and again been alleged that his transfer has been delayed due to his proximity to the ruling government.
In fact, back in April 2016, Advocate Yatin Oza had even written letters to the Chief Justice of India, alleging that Justice Shah was being allowed to continue in Gujarat High Court because of his closeness with the ruling dispensation. Soon after, in August that year, CJI Thakur had taken matters into his own hands, stating that the Supreme Court would have to consider withdrawing judicial work from Justice Shah if his transfer is stalled any further.
The Supreme Court collegium had then recommended Justice Shah’s appointment as the Patna High Court CJ on July 16, 2018.
