Jharkhand HC Grants Bail To Five On Condition That They Serve In A Hospital [Read Order]

The Jharkhand High Court has granted provisional bail to five accused persons in a case (No. 272/17) related to attack on a marriage party on the condition that they perform social service to give some solace to the persons injured in the incident.

Eight persons, including a five-year-old girl, were injured when members of a community allegedly attacked the marriage party in the Sadar police station area of Ranchi city on June 3.

The injured were admitted to Rajendra Institute of Medical Sciences (RIMS) and MEDICA hospitals in the city.

Hearing the bail plea, Justice Chandrashekhar directed that the accused be released on bail on the condition they report to superintendent of RIMS Ranchi on October 3 and November 6 for social service.

The superintendent shall depute them either on traffic management duty at the main gate of the hospital or for managing the patients at open patient department for three hours.

The RIMS superintendent shall submit a report in this regard to the investigating officer who in turn would file an affidavit on their conduct before the high court.

Justice Chandrashekhar said, “I am of the opinion that service to the society would not only be appreciated by members of both communities, it would give some solace to the injured persons also.”

He further said each accused should deposit Rs 15,000 each with the trial court. Rs 20,000 would be given to the 5-year-old girl named Soumya Kumari and Rs 10,000 each would be given to other injured persons.

Justice Chandrashekhar also imposed other conditions on the accused, including a bail bond of Rs 10,000 each and two sureties of equal amount. They have to appear before the trial court regularly but for special circumstances and not change their place of residence without the court’s permission.

One RamadharSahu had registered a case with the Sadar police station alleging that 37 named, along with 300-350 unknown, persons of a community had attacked a marriage party causing injuries to eight persons.

Members of the other community had also registered a case alleging 42 named and 40-50 unknown persons of trying to inflame communal disharmony by assembling unlawfully.
