The Bench headed by Chief Justice of India HL Dattu today referred the plea of an Italian marine seeking extension of his stay in Italy, for consideration before another bench of the Supreme Court.
The Italian Marine, Massimiliano Latorre has been accused of killing two Indian fishermen while being aboard Enrica Lexie. Hearing his plea, the Supreme Court Bench headed by CJI, also having Justice Sikri said, “It is not proper for us to take up the application because we have earlier expressed some reservations and made certain observations”. It added, “Let it be placed before another bench.”
Earlier, the Supreme Court bench headed by Chief Justice of India HL Dattu had refused the marines plea and said that, “Let him come. Let the charge sheet be filed. You know that the charge sheet cannot be filed in the absence of accused. We aren’t going to allow the application.”
