The Uttarakhand High Court recently took suo motu cognizance of a letter written by one Laxman Singh Negi, highlighting the difficulties being faced by disabled persons in receiving their disability pension in the absence of an Aadhaar card.
The letter had mentioned the names of several such people, who had not been able to get their Aadhaar cards due to their disability. It had earlier been reported by TOI that several disabled people in the State could not bear the cost of travel to an Aadhaar centre and had hence missed out on obtaining the same.
Taking note of this letter, the Bench comprising Acting Chief Justice Rajiv Sharma and Justice Manoj Kumar Tiwari now observed, “It is a sensitive matter. It is a fit case where the principle of lex non cogit ed impossibilia applies, which means that the law does not enforce impossibilities. The approach of the entire machinery should be humane and it should evolve a process itself taking into consideration the difficulties faced by the disabled persons.”
It then directed the District Magistrate, Almora to ensure that the Aadhaar cards are issued to those mentioned in the letter before it within three days, after which the authorities have been directed to release the disability pension along with arrears within seven days.
