The National Company Law Tribunal (“NCLT”) has issued a Circular dated 10.07.2023 intimating that proceedings before the NCLT New Delhi would resume only after CPWD (Electrical Department) issues a “Safe to Use” Certificate in respect of the building/premises where New Delhi Bench operates.

Brief background

On 09.07.2023, New Delhi witnessed torrential rainfall. The building/premises in which NCLT New Delhi is situated has been completely inundated with water and thus the electricity supply of the entire building has been disrupted.

Further, the electrical panel room that houses 1100 KV supply line to Block 3 & 4 is submerged in water, which has endangered the safety of the occupants. The lifts are also not operational. Therefore, NCLT proceedings would remain suspended till further order.

The Central Public Works Department (“CPWD”), Electrical Department, would issue a “Safe to Use” Certificate pertaining to electrical and civil side. The building has been evacuated keeping in view the safety of the occupants and the restoration work would also take time.

In view of the above, the NCLT has issued a circular intimating that proceedings would resume at the NCLT New Delhi Bench only after the CPWD issues “Safe to Use” Certificate.
