The National Company Law Tribunal (“NCLT”) has issued a Circular dated 11.07.2023, intimating that NCLT New Delhi would be conducting hearing through Video Conferencing till further orders.

The NCLT New Delhi is awaiting logistic clearance from CPWD in terms of “Fit for Use” for its premises situated at Block III, CGO Complex, Lodhi Road, New Delhi.

Brief background

On 09.07.2023, New Delhi witnessed torrential rainfall. The building/premises in which NCLT New Delhi is situated has been completely inundated with water and thus the electricity supply of the entire building has been disrupted.

Further, the electrical panel room that houses 1100 KV supply line to Block 3 & 4 is submerged in water, which has endangered the safety of the occupants. The lifts are also not operational.

The Central Public Works Department (“CPWD”), Electrical Department, would issue a “Safe to Use” Certificate pertaining to electrical and civil side. The building has been evacuated keeping in view the safety of the occupants and the restoration work would also take time.

Circulars by NCLT

In view of the above, the NCLT issued a circular dated 10.07.2023 intimating that proceedings would resume at the NCLT New Delhi Bench only after the CPWD issues “Safe to Use” Certificate.

Subsequently, a circular dated 11.07.2023 has been issued intimating that NCLT will operate with minimum staff and proceedings will be conducted through virtual mode until further orders.
