The Rajasthan High Court has stayed the transfer of a government school lecturer who had filed a sexual harassment complaint against the school Principal.
After the woman alleged that the 800 km far transfer was a consequence of her complaint, Justice Arun Monga issued notice on her plea and directed:
"Meanwhile, the petitioner shall be allowed to discharge her duties at her current institution/place of posting. In case, she has been formally relieved, the same will not come in her way for reporting/joining back on duty".
The petitioner alleged that pursuant to the inquiry conducted in her complaint, the Principal was put in the category of Awaiting Posting Order (“APO”). However, she was "victimized" further after she was also put in the APO category without any fault on her part.
This APO order was followed by a transfer order wherein she was transferred 800 Kms away from her current posting. It was submitted on her behalf, that she was a single lady taking care of her widow ailing mother who was undergoing the treatment of Ischemic heart disease.
The matter is next listed on March 20.
