Nuh Violence: Haryana Police Names Congress MLA Mamman Khan As Accused, High Court Issues Notice On His Plea For SIT Probe Into Violence

Days after Congress MLA Mamman Khan moved the Punjab & Haryana High Court seeking SIT probe into the incidents of violence that took place in Nuh, the Haryana government has informed the High Court that he is also a named accused in the matter.
Khan had sought constitution of a high level Special Investigation Team (SIT) comprising officers not below the rank of Inspector General of Police. He had also sought protection from coercive steps during the pendency of the enquiry.
However, during the hearing he learnt that he is also named in the FIR. Considering the submissions, Justice Vikas Bahl has granted Khan liberty "to seek appropriate remedy for the protection of liberty in accordance with law."
FIR pertaining to the Nuh violence was registered under Sections 148, 149, 153-A, 379-A, 436, and 506 of IPC. Additional Advocate General Deepak Sabharwal informed the Court that Khan was issued a notice of appearance but he sought 10 days time, following which he was nominated as an accused in the FIR.
As per State, Khan exchanged calls with one of the accused Taufiq on July 29 and 30, just a day before the incident. Additionally, tower data indicated his presence within a 1.5 km radius of the incident site on the mentioned dates. Moreover, a day before the violence Khan had posted on Facebook and WhatsApp that "nobody needs to worry as he (the petitioner) had fought for them in the Vidhan Sabha and will fight for them in Mewat also", State submitted.
Senior Counsel R.S. Cheema appearing for Khan submitted that the factum of his being a named accused was made known to them only during the course of hearing, through AAG's submissions. He nonetheless pressed his primary prayer with respect to constitution of SIT. Court has issued notice on this limited aspect.
Out of total 52 suspects, 42 persons have been arrested and five persons have been named in the FIR, State informed the Court.
The matter is now posted to October 19.
