Punjab & Haryana HC Issues Notice To Jindal Global University On LLM Student's Plea Against Declaration Of His Answer-Sheet As 'AI-Generated'
The Punjab and Haryana High Court on Monday sought response of O.P Jindal Global University on an LLM student's plea challenging the decision of the university to declare his submission in an exam as "AI-generated."
Justice Jasgurpreet Singh Puri while listing the matter for November 14, issued notice to the University.
Kaustubh Shakkarwar, a lawyer by profession filed the writ petition seeking quashing of the decision of the "unfair means committee" wherein his answer-sheet was declared as "AI generated".
The University has alleged that Shakkarwar, who is pursuing LLM from the university had submitted an "AI generated" submission for the subject "Law and Justice in the Globalizing World" and marked him "Failed" in the subject.
Shakkarwar contended in the plea that the submission is his own creation and requested the University to provide specific rule which prohibits the use of Al. He claims the University failed to provide any such document.
"Section 2(d)(vi) of the Copyright Act, 1957, makes it amply clear that, arguendo, if the Petitioner did even use AI, the copyright of the artistic work would lie with the petitioner, and thus the allegation of violation of copyright, fails,” he added.
The petition stated that he also filed protest against the "Unfair Means Committee"' decision but after a delay of 4 month the University informed that the appeal was dismissed.
