Observing that the court is not required to examine the correctness of the expert opinion, the Punjab & Haryana High Court has dismissed an appeal challenging the answer key of a clerk post exam held by Haryana Staff Selection Commission.
Considering that the advertisement was issued in 2015, the revised final key was declared in 2018 and the results have already been declared,the bench of Chief Justice Ravi Shanker Jha and Justice Arun Palli said, “In such circumstances, we do not find that any meaningful purpose would be served by taking up the issue by this Court at this stage.”
The court was hearing the plea against the dismissal of a writ petition by a single judge bench. The petition was dismissed on the ground that the matter has been “examined by an expert committee” and the “Court cannot sit over the same” and express any opinion to the contrary.
Referring to the catena of cases including Rishal and others Vs Rajasthan Public Service Commission and others (2018) 8 SCC 81, the division bench said, “the Court is not required to examine the correctness of the expert opinion.”
