A writ petition has been filed in the Orissa High Court with a prayer to declare Netaji Subhash Chandra Bose as the 'National Son' and to declassify as well as to make public secret files, including Intelligence Bureau (IB) documents, regarding him.
The petition filed by one Pinakpani Mohanty also seeks to declare the birthday of Netaji (January 23) as a 'National Day' and his birthplace museum in Cuttack as a 'National Museum'. The petitioner also sought for a direction to the Union Government to publicise the 'Transfer of Power Agreement, 1947' and also the Inquiry Report of the Mukherjee Commission.
Notably, a Commission headed by former Bombay High Court Chief Justice Manoj Kumar Mukherjee, was constituted in the year 1999 to inquire into the alleged suspicious disappearance of Netaji Bose in the year 1945.
The plea was heard by a Division Bench of Acting Chief Justice Arindam Sinha and Justice Mruganka Sekhar Sahoo on Wednesday. It was submitted on behalf of the petitioner that he had previously written to the Prime Minister seeking the same reliefs, who had referred it to the Ministry of Home Affairs for appropriate action.
However, he submitted that despite such reference, no action has yet been taken by the concerned Ministry. The petitioner sought to submit a memo showing inaction of the Ministry, which the Court denied citing the same to be a separate cause of action.
The Court granted leave to the Deputy Solicitor General of India for the Union Government as well as the Additional Government Advocate for the State Government to file their respective affidavits indicating their stands.
The matter has now been adjourned to February 12.
