The wife of the Accused in the Sidhi Urination Case has moved the Madhya Pradesh High Court challenging the detention order passed against him under the National Security Act.
Kanchan Shukla, wife of Accused-Pravesh Shukla, has averred in the Habeas Corpus plea that the detention order, passed by Sidhi District Collector doesn't indicate the right to make a representation against the order.
It may be recalled that Pravesh Shukla has been accused of urinating upon a tribal man, the video of the incident had gone viral on the social media.
He was thereafter arrested and booked under varios sections of IPC, ST/Sc Act and was booked under the NSA.
The plea, filed by Shukla's wife also states that the order isn't a reasoned one and also it is not for a specified period and hence, it violates the fundamental right of the petitions.
It adds that the order is contrary to Article 22 (5) of the constitution which provides the person so detained, a right to make a representation against the detention not only before the advisory board but also to the detaining authority.
The plea also alleges that Shukla has been arrested due to political reasons.
The incident caused a huge uproar in the state, following which, the CM of the State, Shivraj Singh Chauhan apologized to the victim and washed his feet at his official residence.
