The Kerala High Court has sought personal appearance of concerned Circle Inspector of Police on Thursday (12 December), to explain the facts and circumstances in the contempt petition against CPI(M) State Secretary M V Govindan for allegedly blocking public roads for holding Palayam area conference.
The party conference was held on December 05, which allegedly blocked the road in front of the Vanchiyoor Court complex and Vanchivoor police station.
The Division Bench of Justice Anil K.Narendran and Justice Muralee Krishna S. orally said that it would consider whether the issue has to be taken in a larger perspective. The Court ordered thus:
“The learned additional advocate general would submit that the fourth respondent, Circle Inspector of Police shall be personally present in the court on the day after tomorrow along with relevant facts to explain facts and circumstances. List day after tomorrow at 2 PM.”
The Contempt petition was filed alleging violation of directions of the Court dated June 23, 2010, in WP(C) No. 19253 of 2010, where it was ordered that meetings could only be held on Stadiums, public grounds outside road margins, grounds of educational institutions on holidays, and not on public roads or road margins.
The Court, today, referred to another interim order dated June 08, 2021, in Trivandrum Chamber of Commerce v State of Kerala. The Court observed that in that case, it was held that encroachments, in temporary or permanent form, shall be prevented which affects the right of way or pedestrian facilities on public roads
As such, the matter has been posted to December 12 for further hearing.
