State Congress President K Sudhakaran on Monday appeared in person before the Kerala High Court in a criminal contempt case initiated against him for his alleged remarks against the judiciary.

The Division Bench comprising Justice Anil K. Narendran and Justice Harisankar V. Menon has directed Sudhakaran to file an affidavit in the matter within four weeks.

The case was filed by Advocate Janardhana Shenoy over Sudhakaran's allegedly contemptuous remarks against the judiciary for refusing CBI probe into the murder of Kerala Youth Congress Worker Shuhaib.

Youth Congress worker, Shuhaib aged 29, was hacked to death allegedly by CPI(M) workers in Kannur district on February 12, 2018. Shuhaib's parents had approached the High Court expressing dissatisfaction with the investigation by local police, stating that members of the ruling party were behind the murder.

Initially, a single bench had directed CBI investigation into the murder on the finding that the police investigation lacked transparency. The Order of the single judge was set aside by the Division Bench stating that there was no material to prove that the investigation conducted by the police was biased or unfair.

It is alleged that K Sudhakaran made a speech on August 03, 2019 regarding the judgment of the division bench that refused CBI probe. He allegedly said the order of the Division Bench "lacked sense".  The criminal contempt case was thus filed against Sudhakaran after obtaining sanction from the Advocate General.

The court had initially directed Sudhakaran to appear before it on March 04, 2024. He however moved an application seeking to condone his absence on the said date amid Parliamentary Election. As the said application came to be rejected, Sudhakaran appeared before the Court on Monday.

The matter has now been posted to June 24, 2024.
