CSI Medical College Corruption Case: Kerala HC Declines To Quash ED Chargesheet Against Ex-Church Of South India Bishop

The Kerala High Court on Monday (March 24) has refused to quash the charge sheet filed by Enforcement Directorate against Former Church of South India (CSI) Bishop A Dharmaraj Rasalam in the alleged Karakonam CSI Medical College corruption case.
The former Bishop was arrayed as the second accused by the ED and the matter is before the Special Court dealing with PMLA Cases.
Justice V.G. Arun dismissed Rasalam's petition seeking quashing of today.

The allegation is that in 2019, the former Bishop along with other accused collected over Rs. 7 crore from parents of aspiring students by offering admission to Karakonam CSI Medical College. It is alleged that multiple complaints were filed by parents of aspiring students claiming that officers of the college had collected huge amounts of money from the parents on the pretext of giving admissions in MBBS and PG courses. However, it is alleged, that the admissions were not given.
The plea states that ED registered a Enforcement Case Information Report (ECIR) against Rasalam in 2020.
It was submitted that the Crime Branch has conducted investigation and filed a final report in 2021 before the magistrate's court stating the allegations are false and malicious. It was submitted that the final report also states that false money laundering case was filed to get the refund of admission fees.
On May 8, 2024 the ED filed a complaint in the case pending before the Special Judge, Ernakulam–Special Court for PMLA cases under the Prevention of Money Laundering Act.
It is submitted that the ED intervened and started investigation under Section 44 and 45 of the PMLA in the year 2020. The plea has been filed stating that the ED is carrying the investigation and filing charge sheet without considering the investigation and final report of the crime branch. The plea has been thus moved to quash the charge sheet and proceedings taken by ED arraying the former Bishop as the second accused.
